Terms and Conditions of Sale / Parts Returned for Credit
- Australian Consumer Law
1) Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures of service, you are entitled:
a) to cancel your service contract with us; and
b) to a refund for the unused portion, or to compensation for its reduced value
2) You are also entitled to choose a refund or replacement for major failure with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time.
3) If this is not done, you are entitled to a refund for the goods and to cancel the contract or the service and obtain a refund of any unused portion.
4) You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.
- Conditions of Sale
1) Seller to continue to be legal owner of the goods and Purchaser to hold them as bailee until all sums owing to Seller by Purchaser are paid in full.
2) At any time after the Purchaser fails to make any payment required in full, Seller may without notice retake possession of goods. Purchaser authorises Seller to enter any premises whether occupied by the Purchaser or not, to search and seize the goods without being in any way liable to the Purchaser, whichever occurs first.
3) Notwithstanding 2.1 and 2.2 above, goods are at Purchasers’ risk when property passes to Purchaser or goods delivered to Purchaser, whichever occurs first.
4) On retaking possession of the goods the Seller may elect to refund to the Purchaser any part payment that may have been made. Excluding freight and packaging charges.
5) Any non-genuine parts, accessories, products, or additives are not supplied or approved by us for use in your vehicle. As such they are not covered by warranties in respect of Parts and Accessories. You should also be aware that their use may affect the warranty provided for your vehicle to the extent that these non-Approved products and / or their installation may affect the specifications or the quality of your vehicle.
- Damaged Goods
1) All damaged parts must be notified within 24hrs of delivery – please contact the Parts Sales Team directly to parts@newtowntoyota.com.au & please provide photos of the packaging and damaged part received.
4. Return of Goods
1) Pre-approval from the Parts Sales Team is required for the Return of Goods, please send all Credit Requests to parts@newtowntoyota.com.au
2) Other than where We are required to accept a Return of Goods under the Australian Consumer Law, the following terms are applicable:
a) Items with a value of less than $10 are not refundable.
b) All Return of Goods must be returned in their original packaging and does contain any marks or tears to the actual packaging.
c) Returnable Part/s must be within 21 period of 21 days from date of supply, NO RETURNS accepted after a period of 21 days from date of supply.
d) Returnable Part/s are subject to a 20% handling fee
e) All Air Freight Part/s are strictly Non-Returnable Special Ordered items
f) Any Japan, Melb or Sydney Part/s are strictly Non-Returnable Special Ordered items
g) Any Electrical Part/s are strictly Non-Returnable Special Ordered items
h) Any Glass Part/s are strictly Non-Returnable Special Ordered items
i) Any Panel/s are strictly Non-Returnable Special Ordered items
j) Any Alloy/s are strictly Non-Returnable Special Ordered items
k) Painted parts are not eligible for Return or Credit.
